The High Court in Pretoria has dismissed an urgent attempt by businessman Hangwani Morgan Maumela and the MHR Maumela Family Trust to stop the sale of a Ferrari SF90 Stradale preserved in the Special Investigating Unit’s Tembisa Hospital probe.

The vehicle is to be sold for no less than R9.5 million, with the proceeds preserved in an interest-bearing account while the underlying litigation continues. The court found that the earlier Special Tribunal order authorising the sale was interim in nature and was not automatically suspended by an appeal.

The ruling does not determine the ultimate ownership or alleged proceeds-of-corruption questions. The SIU’s wider investigation concerns alleged corruption and maladministration in procurement at Tembisa Hospital, with the unit saying matters worth roughly R2 billion are under investigation.

The SIU has said entities linked to what it describes as the Maumela syndicate benefited from hundreds of millions of rand in hospital contracts. Maumela and other affected parties have opposed allegations made against them, and allegations of criminal conduct remain subject to legal process.

The immediate significance of the Ferrari ruling is practical asset preservation: high-value vehicles cost money to store, insure and maintain and can depreciate. Converting the car into cash allows the value to remain protected pending the outcome of the civil recovery proceedings.
